The Delhi State Consumer Disputes Redressal Commission has directed German automaker BMW to pay the entire cost of Rs 26.3 lakh, along with damages, to the owner of a 1 series hatchback. The complainant had purchased the car in October 2014 and started experiencing problems just 5 months later. Despite attempts to fix the issues over a period of 8 years, the services provided by BMW were deemed unsatisfactory.
The BMW 1 series (2nd gen) was launched in India in 2013 and discontinued in 2017.
The complainant faced brake issues with his BMW car shortly after 5 months of ownership. After the complaint was made, the manufacturer conducted a joint test drive at BMW’s Manesar R&D centre and acknowledged the poor braking performance. Despite repairs, the complainant did not notice much difference.
According to the court directive, the car manufacturer did not replace the vehicle or rectify the defects, confirming the deficiency in their services.
As a result, BMW has been instructed to reimburse the complainant the full ex-showroom amount of Rs 26.3 lakh for the 1 series hatchback. Additionally, the court has ordered the payment of interest on the loan (Rs 2.26 lakh), 6% interest on the purchase amount, Rs 2 lakh for mental distress and harassment, Rs 50,000 for litigation costs, Rs 1.09 lakh for vehicle service and maintenance, Rs 35,000 for tire replacement, and Rs 93,280 for insurance.
